Transgender Employees: Understand Your Legal Obligations and Best Practices – January 11, 2017
In its strategic enforcement plan for the years 2017-2021, the Equal Employment Opportunity Commission (“EEOC”) lists protecting transgender employees from discrimination on the basis of sex. Over the past five years, EEOC case law has indicated a clear application, at least on the agency level, of discrimination on the basis of sex to transgender employees. Now with access to EEOC case law and guidance from both the EEOC and other agencies, such as the Occupational Safety and Health Administration (“OSHA”), many organizations have endeavored to develop policies that are both inclusive and legally sound. But, with even the best of intentions, policies that single out transgender employees may lead to violations of employment laws. To respond to both the increased agency scrutiny and work towards an inclusive workplace, employers need the tools to develop and implement policies that prohibit discrimination, without singling out transgender employees.
This seminar will help business owners and business, marketing, and HR managers understand how to apply agency guidance, case law issued by the EEOC and relevant court decisions, statutes, regulations, and Executive Orders, which have direct relevance to the transgender employee policies that employers are urged to develop and implement to maintain legally defensible practices and an inclusive workplace.
